1. Parties

"TalkWell Academy", "we", "us", and "our" refer to Kamarun Kalam, operating talkwellacademy.co.uk. "You" and "your" refer to the individual purchasing or accessing course content.

2. The product

TalkWell Academy offers self-paced online courses delivered via the Tutor LMS platform. Course content includes pre-recorded video, written materials, and guided exercises. Content is delivered digitally and is available immediately upon purchase.

Course descriptions, module titles, and included content are set out on the course sales page at the time of purchase. We reserve the right to update or improve content over time, including substituting equivalent material, without prior notice — provided the overall value and scope of the course is maintained.

3. Purchase and access

All prices are in GBP (£) and include VAT where applicable. Payment is processed via WooCommerce and our active payment gateway. A contract is formed when we send your order confirmation email.

Access to purchased courses is tied to your student account. You are granted a personal, non-transferable, non-exclusive licence to access and use the course content for your own private educational purposes for the lifetime of the platform.

We do not guarantee the platform will be available at all times — scheduled maintenance, technical issues, or force majeure events may cause temporary interruption. We will make reasonable efforts to minimise disruption.

5. Permitted use

You may access and use course content for your own personal, non-commercial educational purposes only. You must not:

• Share your login credentials or allow any other person to access your account
• Download, screen-record, copy, reproduce, or redistribute any course content
• Use course content to create a competing product or service
• Publish or publicly share any course materials (including on social media) without written permission
• Use the course content in any commercial context without written permission

6. Intellectual property

All course content — including videos, text, exercises, graphics, and structural design — is the intellectual property of Kamarun Kalam and TalkWell Academy. All rights reserved. Nothing in these terms transfers ownership of any intellectual property to you. The personal licence granted in Section 3 is the full extent of your rights in the content.

8. Limitation of liability

To the fullest extent permitted by UK law, TalkWell Academy's total liability to you for any claim arising from or related to a course purchase is limited to the amount you paid for that course.

We are not liable for any indirect, consequential, or special loss or damage — including loss of earnings, data, or opportunity — arising from your use of or inability to access course content.

Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be excluded under UK law.

9. Accounts and security

You are responsible for keeping your account credentials secure and for all activity that occurs under your account. Notify us immediately if you suspect unauthorised access. We reserve the right to suspend or terminate any account found to be in breach of these terms, including sharing login credentials or making unauthorised copies of content.

10. Termination

We may suspend or terminate your access to course content without notice if you breach these terms. In the event of termination for breach, no refund is payable. If we terminate access for any reason not attributable to your breach, we will refund a pro-rated amount at our discretion.

11. Governing law and disputes

These terms are governed by the law of England and Wales. Any dispute arising from or relating to these terms shall first be referred to us directly for resolution. If a resolution cannot be reached, the dispute shall be subject to the exclusive jurisdiction of the courts of England and Wales.

These terms do not affect your statutory rights as a consumer under UK law, including rights under the Consumer Rights Act 2015.

12. Changes to these terms

We may update these terms to reflect changes in our practices or UK law. The "last updated" date at the top reflects the current version. Where changes materially affect your rights, we will notify active students by email. Continued use of the site after notice of changes constitutes acceptance of the updated terms.
